This document tells you the Terms and Conditions upon which we will supply our Service to you. You may print a copy for future references.

Before confirming your order, please read through our Terms and Conditions, in particular our Extra Charges, Returns and Cancellation Policy.

By ordering any of the Services we may provide, you legally bound by these Conditions and confirm that your age is over 18. You will be unable to proceed with your booking if you do not accept these terms and conditions.

(1)  Definitions

In these Conditions:

“Carrier” is referred to us, MAGS Transport LTD.

“Customer” means the person, firm or the company that contracts the service from the Carrier.

“Contract” means the agreement of the service between the carrier and the customer.

“Consignee” means the person, or a company, to whom the carrier contracts to deliver the Consignment to.

“Consignment” means any goods, whether it is a single piece or in bulk, sent at one time in one load by or for the Customer to the Consignee from one address to another address.

“Delivery Address” means the address of delivery of the Consignment notified by the Customer to the Carrier at the time of the booking.

“Business Day” means a day other than Saturday, Sunday or public holiday when banks in London are open for business.

“Services” means the services listed in our website which we may supply.

(2) Price

Unless otherwise stated, the price of the service excludes VAT, which will be added at the current rate, to the total amount due from you.

Initial quoted price may be subjected to additional charges stated in clause (8), if any of the conditions apply during the service, which will be added to the total amount due from you.

(3) Payment

 The outstanding balance of the Service provided will be sent to you via invoice, after we have performed our Services.

You must pay the amount of the invoice within 30 days of the date of invoice.

Any enquiries regarding an invoice must be disputed within 14 days of the date of invoice.

(4) Bookings

 Upon the acceptance of the quote offered, an “Order Confirmation” will be sent via email, confirming that we shall be providing you with the requested service.

If you think there is a mistake with the Order Confirmation, or would like to make a change, please contact us to discuss this. If any change is requested, we will advise you is this is possible, and if the request is subject to changes to price, delivery or dates, or any other changes as result of the request.

All order is subjected to acceptance and availability. If we are unable to provide a service in your order, due to matters such as the unavailability of key staff, events out of our control, or because we have identified a mistake in the description of the service, or the price stated by us, we will notify you. We will not process the order and will refund the full amount to you, if any payment has been made in advance.

(5) Service Performance 

The address where the Services will take place, in addition to the required dates and time upon which the customer requires the services be provided, shall be provided during the request of the quote.

The order confirmation includes the information of the Service requested.

If you fail to provide access to the premises on the agreed date and time, you must pay us any additional costs added by us due the Service provided to you. Moreover, if we are unable to get access to the premises despite our reasonable efforts, we may end the contract with you. You will be charged with a reasonable amount for the performed Service.

If wrong, inaccurate, or delayed information is provided to us, we will not be liable for any delay or non-performance.

You will be charged for any extra work, or performed service, if correct and requested information are not provided to on time.

If there is a problem with the service, please let us know as soon as possible, and we will try to resolve the matter at our own cost within a reasonable time.

MAGS TRANSPORT LTD is not responsible for any delays or failures in delivery or performance, that are resulting from any act, event, omission, failure or accident outside our reasonable control (‘Events outside our control’).

(6) Loading and Unloading

Unless the Carrier has agreed to the Customer during the booking:

The Carrier shall not be under any obligation to plant, power, or labour, other than that provided by the vehicle, to load or unload the consignment.

The Customer should ensure that any equipment used to load and unload the consignment is suitable to the vehicle requested.

The Customer should ensure that the premises used to load and unload the consignment shall have sufficient space to carry the Service in Safety.

(7) Cancellations

 The customer may cancel the order up to 24 hours after receiving the ‘Order Confirmation’ and receive a full refund.

If an order is cancelled within 24 hours of the collection, the carrier will attempt to cancel the order and issue a refund where possible, price is subject to admin fee (clause (8)) . If, however, the Carrier is unable to cancel without incurring costs, those costs shall be passed to the customer and if the Consignment has been collected by the carrier, the costumer would not be eligible for a refund.

(8) Charges

 Payment terms are 30 Days from the invoice date.

Proof of Delivery (PODs) are available upon request only.

Waiting time

Applies after 30 minutes.

Vehicles from Small Van > Luton Van = £20/hour

7.5 Tonne > Artic = £30/hour

Cancellation

Subject to Notice Time (check clause (7)).

If driver is on site collection – 100% Cancellation Fee.

If cancellation is after 24 hours of receiving the Order Confirmation – £20 Admin Cancellation Fee + (if any occurring costs).

If Cancellation within 24 hours of receiving Order Confirmation – 0% Cancellation Fee.

Hand-balling Charges

Small Van > Luton Van = £20/hour

7.5 T > Artic = £40/hour

Rebooks, Returns, Refusals and Additional Drops or Load charges require to be discussed with MAGS Transport advisors who would be able to provide a quote.

Additional Changes:

Congestion Charge: Charged as current rate

ULEZ: Charged as current rate
